The Summer Village of Bonnyville Beach has updated its Composite Assessment Review Board (CARB) Bylaw to reflect changes in the appointment process and ensure compliance with the Municipal Government Act (MGA) and the Matters Relating to Assessment Complaints Regulation (MRAC).

Purpose:

The Composite Assessment Review Board (CARB) hears complaints about:

  • Non-residential property assessments
  • Residential properties with four or more dwelling units
  • Any assessment matters requiring a CARB under provincial law

This bylaw establishes how the Board operates and ensures that assessment complaints are handled fairly, transparently, and in accordance with Alberta legislation.

The amendment updates Section 4.1, delegating the appointment of CARB members to the Municipal District of Bonnyville No. 87.

Key Provisions

Establishment of the Board

  • The CARB is officially established under this bylaw.

  • It operates under the authority of the MGA and MRAC.

Board Composition

A CARB includes:

  • One provincially appointed member (the presiding officer)
  • Up to two additional members appointed through the MD of Bonnyville No. 87

All members must complete the required provincial training.

Appointment of Members (Amended Section 4.1)

Updated Section 4.1 now reads:

  • Council delegates the authority to appoint CARB members to the Municipal District of Bonnyville No. 87.

Additional details:

  • The Chair is appointed by the Province
  • All Board members must meet training and qualification requirements

Powers & Duties of the Board

  • The CARB is responsible for:
  • Hearing complaints about non-residential assessments
  • Hearing complaints about multi-unit residential assessments (4+ units)
  • Conducting hearings fairly, impartially, and in accordance with natural justice
  • Issuing written decisions within provincially mandated timelines

Clerk of the Board

  • A Clerk position is established to support the Board
  • Appointed by the CAO or designate
  • Responsible for:
    • Scheduling hearings
    • Giving notice to parties involved
    • Maintaining records
    • Communicating decisions

Severability & Effective Date

If any section is found invalid, the remainder stays in effect

This bylaw took effect after its final passing on August 30, 2025
